  • Indiana & Michigan Power Co. v. Siemens, U.S. District Court, SD of Ohio
    Represented Siemens as defendant and counterclaimant in a dispute relating to millions of dollars incurred in the repair of Siemens' turbines at a nuclear facility.
    Successfully obtained dismissal of the plaintiff's breach of contract and breach of warranty claims as initially filed and as amended. The case was settled following mediation.

  • Imo Industries, Inc. v. Siemens DeMag Delaval Turbomachinery
    Secured summary judgment for defendants on a counterclaim for contractual indemnity of asbestos claims under an asset purchase agreement. The judgment was affirmed by the Delaware Supreme Court.

  • Tokyo Kikai Seisakusho (TKS USA) v. Perkins Coie, DC LLP, DC Superior Court
    Represented plaintiff, a printing press manufacturer, against a law firm in a legal malpractice case stemming from work involving anti-dumping laws on imported products. The case settled for $19 million.

  • White v. Kenneth Warren & Son, et al

    Represented executors of an English estate in action against defendant appraisers and violin dealers for the conspiracy to defraud the estate out of the fair value of rare violins.
    Attracting international attention and feature articles in the Guardian, Wall Street Journal, and Chicago Tribune, the case settled days before trial

Antitrust Opt-Out Matters

  • Broiler Chicken Antitrust Litigation ND IL, case no. 16cv08637

    Representing numerous opt-out plaintiffs consisting of grocery store chains and a wholesaler who purchased raw whole birds and breast meat chicken from defendants that control nearly 90% of the broiler chicken market, valued at $28.7 billion in 2015.
    The case is set for trial in September 2023.

  • Pork Antitrust Litigation, MN, case no. 18cv01776

    Representing numerous opt-out plaintiffs consisting of grocery store chains and a wholesaler who purchased pork from the defendants.
    The plaintiffs alleged that the pork manufacturers violated federal law by working together to raise and fix the price of pork products purchased by the plaintiffs.

  • Beef Antitrust Litigation, MN, case no. 20cv1319
    Representing numerous wholesalers and grocers against the world’s largest beef processing and packing companies, alleging defendants conspired to limit beef supplies to artificially raise prices in violation of antitrust laws. The case is ongoing.

  • Capacitors Antitrust Litigation, ND Calf, case no. 14cv3264

    Representing Flextronics against a group of capacitor manufacturers for antitrust price-fixing violations. The class action trial started in March 2020 but was halted due to concerns over COVID-19. The claims were successfully settled against all defendants.

  • Resistors Antitrust Litigation, ND Calf., case no. 15cv3820

    Representing Flextronics against a group of resistor manufacturers for antitrust price-fixing violations, discovery is ongoing.

  • Package Seafood Products Litigation, SD Calf., case no. 2015cv2500

    Represented a group of wholesalers and grocery store chains against tuna manufacturers for antitrust price-fixing violations.
    The case was settled against 2 of 3 defendants and the last defendant filed for bankruptcy, but several claims are still pending.

  • Lithium Ion Batteries, ND Calf. case no. 13md2420

    Represented Flextronics against large LIB manufacturers for antitrust price-fixing violations. The case settled favorably shortly before trial.
